Judicial Panel to Reexamine Ruling That Allowed Trump to Deploy Troops to Oregon City

Appeals Court Agrees to Rehear Legal Matter
The ninth circuit court of appeals ruled on this week that it would reexamine the case concerning the executive power with an expanded panel of eleven justices. The judicial body also vacated a previous ruling from a three-judge panel that had sided with the federal government.
Legal Saga Over Military Presence
This order represents the latest turn in a long-running court case over whether the administration has the legal right and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was started in response to ongoing demonstrations.
Conflicting Arguments
The federal government has argued that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that municipal police have command of the situation.
Contrary to descriptions of the city as a conflict zone, residents have been sharing videos of lush hiking trails and a vibrant culinary culture, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.
Recent Legal Actions
The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this period – one blocking the federalization of the state troops, and another stopping the use of any military personnel in Oregon, after efforts to evade the initial injunction by calling up troops from California.
On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of 200 Oregon national guard – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a panel of 11 judges.
“This decision shows that the truth matters and that the judicial system are working to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a statement.
“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into US cities unnecessarily. We will continue protecting state legislation, values, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
